Question:

238 Ms Fitzgerald asked the Minister for Justice, Equality and Law Reform the approach being taken by his Department in relation to three persons (details supplied) in prison here following a transfer from the UK and whose rights to Irish residency have been established. [20293/01]

The persons in question all made separate applications for permission to remain in the State as the parents of Irish citizens. Applications of this nature are processed in chronological order and one of the three appli cations has been approved. None of the persons in question is in detention either here or in the UK. Two of the persons returned to the State from the UK in recent weeks and were not detained upon arrival. The third is currently in his home country and recently made a visa application to return to the State. This application has been approved.
