77 Mr. Perry asked the Minister for Defence if he will waive or reduce the £1,000 back payment requested from a person (details supplied); and if he will make a statement on the matter. [22694/01]

The military authorities have advised that the individual in question enlisted in the Air Corps as an apprentice on 15 January 2001 for a period of nine years permanent Defence Force service and three years reserve service.

Should the individual now apply for his discharge from the Defence Forces his cause of discharge would be in accordance with Defence Force Regulations DFR A10, paragraph 58(f2>h) "By Purchase".

As the individual has completed more than three months service and less than one year's service the cost of his discharge by purchase would in accordance with DFR A10, paragraph 61(f2>g) (f2>b)(i) be £1,000. The individual would not qualify for a reduction in this purchase price in accordance with DFR A10, paragraph 61(3) as he has completed less than half of his original engagement of 12 years service. As the regulations are of general application, exceptions cannot be made in individual cases.
