Question:

87 Mr. Creed asked the Minister for Agriculture, Food and Rural Development the procedures regarding arbitration on compensation payments for BSE outbreaks; and if all avenues have been exhausted in the case of a person (details supplied) in County Cork. [22559/01]

BSE legislation provides for a three stage valuation procedure. The first stage is the valuation of the herd on behalf of the Department. If the herdowner rejects the valuation, an independent valuer is appointed from a list of such valuers maintained by the Department. In the event of the herdowner rejecting this second valuation, an independent arbitrator will be appointed.

In this particular case, the herdowner agreed to the Department valuation on 17 September 2001 and the herd was subsequently depopulated. The file is currently being processed for payment and will issue shortly.
