Written Answers. - Off-licence Applications.

209 Mr. J. Bruton asked the Minister for Finance the way in which an application may be made on behalf of a person (details supplied) in County Meath who wishes to apply for a licence to run an off-licence on his business premises; the length of time the application will take to process; the documentation this person needs to submit; and if he will make a statement on the matter. [23142/01]

I am informed by the Revenue Commissioners that there are two types of off-licences, a full off-licence which entitles the holder to sell beer, wine and spirits and a wine off-licence which covers only the sale of wine. The procedures differ as between the two types of licence.

To obtain a full off-licence an individual must first apply to the Circuit Court for a certificate authorising Revenue to issue such a licence. I am not in a position to advise the Deputy regarding documentation, timescale or other requirements of the Circuit Court. Having obtained a court certificate, the applicant must submit to the local collector of Customs and Excise the court certificate, a current tax clearance certificate issued by the Collector General and the appropriate duty. If the applicant is a company, a certified copy of the certificate of incorporation issued in accordance with section 370 (1) (b) of the Companies Act, 1963, must be submitted and if the business trades under a name other than that appearing on the court certificate, a certificate of registration of business name under the Business Names Act, 1963, section 16(1) (b) must be submitted. If all the above are in order, the licence will be issued immediately.

To obtain a wine off-licence an individual must submit to the local collector of Customs and Excise an application form, a current tax clearance certificate issued by the Collector General, the appropriate duty and, if the applicant is a company, a certified copy of the certificate of incorporation issued in accordance with section 370 (1) (f2>b) of the Companies Act, 1963, and, if the business trades under a name other than that appearing on the court certificate, a certificate of registration of business name under the Business Names Act, 1963, section 16(1) (b). The collector will issue this licence within seven days if he is satisfied that all aspects of the application are in order.
