Question:

114 Dr. Upton asked the Minister for Justice, Equality and Law Reform if a person (details supplied) will be given permanent status. [23553/01]

My Department is reviewing the status of the person in question who has resided in the State without permission to remain or without authorisation to operate a business since May 1997. In these circumstances, it would not be appropriate for me to grant the person in question any form of indefinite permission to remain.

Question:

115 Dr. Upton asked the Minister for Justice, Equality and Law Reform the position regarding an application for asylum by a person (details supplied). [23554/01]

The applicant in question has made an application seeking leave to judicially review the asylum decision in his case. As this matter is before the High Court it would not be appropriate for me to comment on this case at present. Until the legal proceedings are completed a final decision on his status within the State will not be made.
