Question:

48 Mr. O'Shea asked the Tánaiste and Minister for Enterprise, Trade and Employment the proposals she has to amend the Irish Takeover Panel Act, 1997, to meet concerns expressed in this regard (details supplied); and if she will make a statement on the matter. [23550/01]

Under the Irish Takeover Panel Act, 1997, the panel has been given statutory responsibility to monitor and supervise takeovers and other relevant transactions so as to ensure that the provisions of the Act, including the general principles applicable to the conduct of takeovers set out in the Act, and any rules made by the panel under the Act, are complied with.

I do not believe the panel has improperly carried out its responsibilities under the Irish Takeover Panel Act, 1997, in regard to the case in question or that there is a need to amend the Act.
