The person named applied for special beef premium on 33 animals on 16 May 2001. EU regulations require that animals must be held for a two month retention period. However, five of the animals were sold and one was slaughtered on 16 July, thereby incurring a penalty of loss of premium on six animals and a reduced payment in respect of the remaining animals on the application. The person named has been informed of the procedure to be followed if he wishes to appeal the decision.

On the basis of the declarations, he did not qualify for premium but following the investigations his stocking density has been recalculated and it has been found that he is, in fact, eligible for the premium. Arrangements are being made to have the premium paid in early course.
