317 Mr. Gormley asked the Minister for Finance the reason a company (details supplied) is not covered by the Freedom of Information Act, 1997. [26526/01]

Not all bodies are eligible in law for inclusion under FOI. The criteria are set out in Schedule 1 to the Freedom of Information Act, 1997, which confines the operation of the Act, in effect, to the public sector or bodies exercising statutory functions.

I have been informed by the Minister for the Environment and Local Government that the company concerned is a private sector company established by IBEC and funded by industry. It does not operate under the aegis of his Department or any other Department and consequently it does not come under the Freedom of Information Act, 1997.
