Question:

353 Dr. Upton asked the Minister for Health and Children if, further to the reply to Parliamentary Question No. 168 of 4 July 2001, he has received a response to his correspondence to the ERHA; and the further steps he proposes to take against a company (details supplied) for its refusal to act on breaches of by-laws regarding smoking. [26066/01]

The Eastern Regional Health Authority has advised that it is prepared to investigate complaints regarding smoking on Dublin Bus services if the measures being taken by the company are not proving successful. If smoking occurs on a bus it is possible, if there is sufficient evidence, for the area health board to prosecute the offending individual and/or Dublin Bus or a Dublin Bus representative.
