388 Mr. Kenny asked the Minister for the Environment and Local Government the number of cases in which Section 29 of the Planning Act, 1963, has been invoked in the past three years in planning permission cases; the number of cases where local authorities subsequently purchased the ground; the number which have been determined by An Bord Pleanála; and if he will make a statement on the matter. Section 29 of the Local Government (Planning and Development) Act, 1963, permits a person to serve a notice on the planning authority requiring it to purchase his or her interest in land. This notice may be served where, in a case determined on appeal, planning permission has been refused for development of land, or permission granted on the land subject to conditions and the owner of the land claims that it has been, as a consequence, rendered incapable of reasonably beneficial use. According to the statistics collected by my Department for 1998 and 1999, and provisionally for 2000, 12 purchase notices were served on planning authorities in that period. One site was subsequently acquired by a planning authority during 2000. Twelve appeals relating to purchase notices were determined by An Bord Pleanála in that period.
