Question:

157 Mr. M. Higgins asked the Minister for Foreign Affairs the response the Minister of State has received to representations she made to the Kenyan President regarding the shooting dead by police in 1997 of a person (details supplied); and if he will make a statement on the matter. [29268/01]

In the course of the recent visit by the President, Mary McAleese, to Kenya, the Minister of State, Deputy O'Donnell, raised with President Moi of Kenya the case referred to in the Deputy's question. President Moi undertook to look into the matter.

Since the Minister of State's discussions with President Moi, it has been reported to me that the policeman, who was charged with the murder of the person referred to in the Deputy's question, was brought to court on November 8 and that the judge ordered that the case be mentioned on November 22 in order to set a hearing date.

I have asked the Honorary Consul to stay in contact with President Moi's office about this case and to report to me on developments. I am anxious to see this matter brought to a conclusion as soon as possible.
