Question:

220 Mr. McGuinness asked the Minister for Health and Children if his attention has been drawn to the fact that further to Parliamentary Question No. 338 of 20 November 2001, the further correspondence referred to in his reply is further questions to the applicant; the reason the information requested is not being given; and the further reason the applicant must state her intentions in relation to the use of the information if released. [29904/01]

The Deputy will appreciate that under the Freedom of Information Act, 1997, it is a matter for the health board or hospital, from which the records are sought, to process the application in accordance with the terms and procedures set down by the Act. If an applicant is not satisfied with the decision made in relation to their application under the Freedom of Information Act, 1997, or in its implementation, he or she then has the right to use the appeal mechanisms provided by the Act. My Department, therefore, has no function in relation to the implementation of the Act by the agency concerned in this specific case.
