Question:

283 Dr. Upton asked the Minister for Justice, Equality and Law Reform if a tachograph chart has been taken from the heavy goods vehicle involved in an accident (details supplied). [30038/01]

I am informed by the Garda authorities that the accident referred to by the Deputy is being investigated by them. As part of the Garda investigation, I am further informed that a tachograph was taken from the heavy goods vehicle for examination.

284 Mrs. Owen asked the Minister for Justice, Equality and Law Reform if his attention has been drawn to a scheme (details supplied); the legal position regarding an operation of this kind of scheme; if the Garda have been alerted to investigate its operation; and if he will make a statement on the matter. [29493/01]

I am advised by the Garda authorities that the Garda Bureau of Fraud Investigation is aware of the scheme in question, and that its investigations to date have not revealed a breach of criminal law. I am further informed by the Garda authorities that each report received is examined on an individual basis and if a breach of criminal law is disclosed the matter will be fully investigated. While the structure of the scheme resembles that of the pyramid selling schemes, the Garda authorities are not of the opinion that it is in breach of the Pyramid Selling Act, 1980, as it does not involve the supply of goods and services as provided for in section 1 of the Act.

As the Deputy is probably aware, the Minister for Enterprise, Trade and Employment has requested the Attorney General to consider the legality of such schemes.
