Question:

220 Mr. Roche asked the Minister for Finance if he will, under the State Property Act, 1998, waive the State interest in the green areas (details supplied) in County Wicklow. [30838/01]

The green area in question at Sidmonton Court, Bray, became vested in me, as Minister for Finance, under Section 28 of the State Property Act, 1954, upon the dissolution of Durkan Brothers Limited, later known as DB (Dublin) Limited, the company which developed the Sidmonton Court estate. Unlike the roads and other open areas within the estate the green area in question was not taken over by the local authority. An application was received for a waiver in respect of a small portion of the green areas in order for the applicant to gain assess to an adjacent site purchased by the applicant for the purposes of building a house. From a legal point of view the Chief State Solicitor recommended that a right of way over the green area be given in this case under section 31 of the State Property Act, 1954. This recommendation was accepted by my Department and submitted to the Government contracts committee which approved the decision.

In the interests of fairness all applications from whatever source for a waiver of the State's interest in this green area will be given full consideration.
