Question:

261 Mr. Perry asked the Minister for Health and Children if his attention has been drawn to the fact that due to psychological reasons a doctor referred a person (details supplied) in County Sligo for surgery for a congenital abnormality; if he will authorise payment to cover the cost of the surgery; and if he will make a statement on the matter. [30765/01]

The position taken by VHI regarding coverage of the surgery provided to the person concerned is set out in its rules, which have regard to the provisions of the Health Insurance Act, 1994 (Minimum Benefit) Regulations, 1996.

Inquiries made by my Department of VHI have ascertained that the matter of payment of benefit in this case was the subject of correspondence between VHI and the person concerned prior to the medical procedure being undertaken. I am further informed that VHI's consideration of the matter at that time included a review, on appeal, by its medical adviser.

It is solely a matter for VHI to determine the application of its rules relating to benefit payment in circumstances of the kind raised in the Deputy's question. I have no function in authorising payment to cover the costs involved.
