Written Answers. - Prevention of Corruption (Amendment) Act, 2001.

Question:

158 Mr. Howlin asked the Minister for Justice, Equality and Law Reform the reason, in making an order for the coming into operation of the Prevention of Corruption (Amendment) Act, 2001, he specified that section 4(2)(c) of the Act should not come into operation at the same time as the rest of the Act; and when he anticipates making an order commencing that particular provision of the Act. Section 4 of the Prevention of Corruption (Amendment) Act, 2001, provides that a presumption of corruption will arise in certain circumstances, including in relation to the exercise of certain functions under the Planning and Development Act, 2000. Commencement of subsection 4(2)(f2>c) is dependent on all the relevant sections of the Planning and Development Act, 2000, also being in operation. However, there are a number of relevant sections of that Act which are not yet in operation. Accordingly, subsection 4(2)(f2>c) cannot be brought into operation at present. It is my intention to make an order bringing subsection 4(2)(f2>c) into operation as soon as all the relevant sections of the Act have been commenced.
