Question:

43 Mr. McDowell asked the Minister for the Environment and Local Government the number of cases in which the European Commission has initiated legal action or announced that it intends to take legal action, arising from the failure by the Government to implement EU directives for which his Department has responsibility; the steps he is taking to ensure that all of these directives are implemented in full; and if he will make a statement on the matter. [31119/01]

I refer to the reply to Question No. 81 of 6 November 2001. The position regarding legal action and implementation of relevant directives remains unchanged. However, as the waste management planning process has been completed, my Department has formally requested the European Commission to apply to the European Court of Justice to close the case concerning the making of waste management plans.
