Question:

85 Mr. N. O'Keeffe asked the Minister for Agriculture, Food and Rural Development if he will waive a penalty imposed on a person (details supplied) in County Cork. [31304/01]

The person named applied for special beef premium in respect of seven animals on 2 July.

EU regulations require that animals must be held for a two month retention period. The person named was informed in writing on 6 July that the first date on which the animals listed on the application could be sold was 3 September. However, five of the seven animals were slaughtered on 29 August, incurring a 100% reduction penalty on this application. The person named has been informed of the procedure to be followed if he wishes to appeal the decision.

86 Mr. T. Hayes asked the Minister for Agriculture, Food and Rural Development the reason a slaughter premium payment was not made to a person (details supplied) in south Tipperary; and if he will make a statement on the matter. [31337/01]

The person named qualifies for slaughter premium and national envelope payments in respect of 123 animals for the year 2000. It is a condition of payment that slaughter premium beneficiaries sign and return to the Department a producer acknowledgement form confirming that the terms and conditions of the scheme have been noted. The person named was issued with three reminders to submit the producer acknowledgement form and has only done so recently.

Payment of slaughter premium and national envelope under the 2000 scheme will issue within the next three weeks.

The person named has no animals eligible for slaughter premium in the January to June 2001 period. Animals slaughtered-exported from July will be processed for eligibility for slaughter premium payment within the next three weeks.
