Question:

156 Mr. U. Burke asked the Minister for Agriculture, Food and Rural Development if he will make a suckler cow premium grant payment to a person (details supplied) for 2001; if he will waive the penalty imposed on this person under sections 26 (iii) and 32; and if he will make a statement on the matter. [31889/01]

The person named applied on three animals under the 2001 suckler cow premium scheme on 11 May 2001. He disposed of one of these animals within the six months retention period of the scheme and did not notify my Department's district livestock office within ten days of the replacement of this animal as is required under clause 26 (ii) of the terms and conditions of the scheme. My Department notified the person named of the position by letter of 29 November 2001 and advised him that no premium was payable on this animal and that the premium due on his remaining eligible animals would be subject to a reduction penalty in accordance with clause 32 of the terms and conditions. He has been given the opportunity to have this decision reviewed by writing to my Department within 21 days setting out any new evidence which may support his case. To date, no reply has been received from him.
