Question:

71 Mr. McGuinness asked the Tánaiste and Minister for Enterprise, Trade and Employment the steps which must be taken by a person (details supplied) in County Kilkenny to regularise his stay in this country and obtain a work permit; if her attention has been drawn to the fact that this person came through immigration in the normal way and was not aware that he entered illegally. [31747/01]

The individual concerned entered the State earlier this year on a three months visa and is now illegally resident here.

He will need to regularise his immigration status with the Department of Justice, Equality and Law Reform and in the interim, if a prospective employer wishes to apply for a work permit on his behalf, he may do so.

Any work permit cannot issue until the immigration status of the prospective employee has been regularised.

72 Mr. Penrose asked the Tánaiste and Minister for Enterprise, Trade and Employment the reason a person (details supplied) in County Dublin only received a D employment visa instead of a working visa; if she will have the case reviewed; and if she will make a statement on the matter. [31841/01]

A D visa is issued by the Department of Justice, Equality and Law Reform and allows a person to seek to enter the State for a period longer than 90 days. In order to work, a person in such circumstances would require a work permit.

I am informed by the work permits section of my Department there is no record of having received a work permit application on behalf of the individual concerned. Any questions relating to visas should be addressed to my colleague the Minister for Foreign Affairs, whose Department will have a record of the original application.

Question:

73 Dr. Upton asked the Tánaiste and Minister for Enterprise, Trade and Employment the position regarding an application for a work permit by a person (details supplied) in Dublin 6W. [31842/01]

Additional information has been requested from the employer and on receipt of same the application will be further considered.
