139 Mr. Callely asked the Minister for Health and Children the status of the McSweeney case; if there is an agreement in this regard; if there are amendments arising to the 1996 pharmacy regulation in this regard; the period of time this issue is under review; and if he will make a statement on the matter. The Health (Community Pharmacy Contractor Agreement) Regulations, 1996 (S.I. No. 152 of 1996), specify the criteria and procedures under which the chief executive officer of the relevant health board shall determine the issue of new community contractor agreements for the provision of community pharmacy services under the Health Act, 1970. A case was taken in relation to the regulations by the McSweeney Group Limited in 1998 and amendments to the regulations were required on foot of the settlement terms made. These amendments are under consideration at present. Proceedings were re-entered but the matter has now been adjourned until January next.
