Question:

53 Ms Shortall asked the Minister for Justice, Equality and Law Reform if he has received the report commissioned by the Garda Commissioner into the death of a child (details supplied) on 30 August 2001; if it is intended to publish the report; and if he will make a statement on the matter. [32099/01]

I have been informed by the Garda authorities that the Garda report into this incident, which examines and investigates all aspects of the circumstances surrounding it, is almost complete and a file will be submitted to the DPP for his directions. If this criminal investigation shows up any areas of procedure that require review, these will be examined by the Garda authorities. I am further informed that a report is also being prepared for the coroner. The matter will, in due course, be the subject of a coroner's inquest.

As the Deputy will appreciate, it would be inappropriate for me to comment any further on the matter, at risk of prejudicing the Garda investigation.
