Question:

302 Mr. Allen asked the Minister for Justice, Equality and Law Reform if he will examine the procedures adopted by the Land Registry in issuing duplicate deeds where original deeds sent by the Land Registry did not arrive with the local authority solicitor and whereby duplicate deeds would be supplied without a formal application involving advertisements in the media and the Law Society Gazette. [3552/02]

I am informed by the Registrar of Titles that original land certificates are issued by the Land Registry pursuant to Section 28 of the Registration of Title Act 1964 and rule 155 of the Land Registration rules, 1972. A duplicate land certificate may be issued by the registry pursuant to rule 170, where the registrar is satisfied that the original has been lost.

I am further informed that a formal application, on affidavit, is required in respect of an application for a duplicate certificate and, that each application must be considered on its merits. Advertisements in the media and in theLaw Society Gazette may also be required. I understand that in circumstances where an original land certificate has not been received by the addressee, a formal application, on affidavit, is necessary to allow a duplicate certificate to issue.
