Question:

308 Mr. Gregory asked the Minister for Justice, Equality and Law Reform if he will review the application of a person (details supplied) for refugee status, on humanitarian grounds. [3171/02]

The person in question arrived in the State on 7 December 1999 and sought asylum. Following an interview, it was concluded that his application was not such as to entitle him to a declaration as a refugee. He was informed of this decision on 16 August 2001. His subsequent appeal was refused by the refugee appeals tribunal on 30 November 2001.

In accordance with section 3 of the Immigration Act, 1999, the person in question was informed on 16 January 2002 that it was proposed to make a deportation order in his case. He was given the alternatives of either making representations within 15 working days setting out reasons why he should be allowed to remain temporarily in the State, leaving the State before the order is made or consenting to the making of a deport ation order. His reply is still awaited and I expect the case file to be submitted to me for consideration shortly.
