Question:

313 Mr. M. Higgins asked the Minister for Justice, Equality and Law Reform the position regarding the asylum application of a person (details supplied); and if he will make a statement on the matter. [3179/02]

The position is that the asylum application of the person in question was unsuccessful. He has, however, recently been granted permission to remain in the State on the basis of his marriage to an Irish national.

I refer the Deputy to my reply to his question of 31 May 2001. Following the issue of a deportation order against the person in question, in June 2001 she instituted judicial review proceedings. As these proceedings are currently before the courts it would be inappropriate for me to comment further on this matter.

315 Mr. M. Higgins asked the Minister for Justice, Equality and Law Reform the situation regarding the asylum application of a person (details supplied); and if he will make a statement on the matter. [3181/02]

I refer the Deputy to my reply to his question of 3 July 2001 in relation to the asylum application of this person. The person in question has since instituted judicial review proceedings against the decision of the Refugee Appeals Tribunal. As these proceedings are currently before the courts it would be inappropriate for me to comment further on this matter.

316 Mr. M. Higgins asked the Minister for Justice, Equality and Law Reform the status of a deportation order issued against a person (details supplied); and if he will make a statement on the matter. [3182/02]

I am informed that there is no deportation order in respect of the person concerned. In relation to the asylum application mentioned by the Deputy I would point out that under the Refugee Act, 1996, as amended, the Office of the Refugee Applications Commissioner is responsible for considering applications for a declaration as a refugee at first instance and the Refugee Appeals Tribunal is responsible for consideration of appeals. A decision on the application in question will be made upon receipt of the decision of the Refugee Applications Commissioner or the Refugee Appeals Tribunal as appropriate.
