Question:

402 Mr. Higgins (Mayo) asked the Minister for Education and Science if he will institute an investigation regarding the appointment to senior posts at a post-primary school (details supplied) in County Galway. [3471/02]

I propose to take Questions Nos. 401 and 402 together.

Appointments to assistant principal and special duties teacher posts of responsibility in community schools are made by the board of management. Circulars issued by my Department prescribe detailed procedures and criteria which apply to boards in selecting teachers for appointment to posts of responsibility. The procedures include provision for the submission of an appeal by an unsuccessful candidate against a proposed appointment to an independent arbitrator. These procedures are designed to ensure that selection processes operate fairly and that individuals who may have grievances have the opportunity to have their case heard and determined by an independent arbitrator. In the case of the school referred to by the Deputy an appeal was lodged against a proposed appointment to an assistant principal post. The appeal was upheld by the arbitrator and, in accordance with the agreed procedures, a new competition for the filling of the post was held. To date, my Department has not been informed by the school authorities of the outcome of that competition.
