113 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if his attention has been drawn to the agreement in relation to the Land Commission and a purchaser for sale of a right of turbary dated 17 August 1940; if the entitlement under this agreement remains in place; if the new owner (details supplied) in County Sligo is permitted to put sheep in this cutaway; if this person is permitted to sell his turbary rights or give permission to somebody to cut turf in 2002; and if he will make a statement on the matter. [3854/02]

The fee simple of the plots the subject of the question, were sold in 2000 to a third party. The rights of the fee simple owner and the turbary right owner are a matter for the persons concerned.
