Question:

116 Mr. M. Higgins asked the Minister for Foreign Affairs further to the EC Council regulations on the development of the second generation Schengen information system, the implications for Ireland in view of the anti-terrorist legislation introduced in Britain and the derogation from the European Charter on Human Rights of the Council of Europe on Britain's part, in view of the fact that this may affect the Schengen Acquis on the free movement of persons within the European Union; and if he will make a statement on the matter. As I indicated in reply to a question in the House on 7 February, I am satisfied that none of the measures of the Anti-Terrorism, Crime and Security Act, 2001, to which I understand the Deputy refers, will have a greater effect on Irish persons living in the UK than on British nationals or other UK residents.

As for the implications of this Act with respect to Ireland's participation in the Schengen Acquis, this is a matter which would more appropriately be directed to my colleague the Minister for Justice, Equality and Law Reform.
