167 Mr. Deenihan asked the Minister for Agriculture, Food and Rural Development when area aid based payments for 2001 will be made to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [5802/02]

A herdowner must submit a valid area aid application for the relevant year in order to be considered for payment under the disadvantaged areas compensatory allowance scheme. No area aid application was received from the person named for the year 2001 and, consequently, no disadvantaged areas compensatory allowance scheme payment can be made for the year in question.

168 Mr. Penrose asked the Minister for Agriculture, Food and Rural Development whether his Department's appeals unit has received an appeal from a person (details supplied) in County Westmeath; if he will ensure that the penalty is reconsidered; and if he will make a statement on the matter. [5819/02]

The herdowner lodged an appeal on 23 January 2002 concerning his 2001 suckler cow premium application. Appeals require individual examination and are dealt with in the order in which they are received. This appeal will be examined in due course and the herdowner will be notified of the outcome.
