Question:

388 Dr. Upton asked the Minister for Justice, Equality and Law Reform the position regarding a person (details supplied) in Dublin 6; and if he will make a statement on the matter. [5698/02]

The position is that the per son in question was granted a visa in March 2001 in order to join his spouse in the State. After his arrival in the State he registered with the immigration registration office, Harcourt Square and was granted permission to remain for a further month, up to the expiry date of his wife's permission to remain. He was also advised to return with his wife when her work permit had been renewed in order for his own permission to be extended accordingly. I understand from the Garda authorities that they have no record of his returning in order to do so.

In order to regularise his position, the person in question should attend the Immigration Registration Office together with his wife and details of her own permission to remain. Consideration can subsequently be given to whether he can be permitted to seek employment, subject to an employer obtaining a work permit in respect of him.
