Question:

101 Mr. Kenny asked the Minister for the Marine and Natural Resources if he will amend the present scheme for field grades employed by the Central and Regional Fisheries Board in relation to the day subsistence allowance; if he has considered a reduction for field grades in the subsistence allowance beyond the 15 miles recommended by the Labour Court on 10 December 2001; if he has considered calling both management and union representatives together to initiate discussions on a cost neutral basis that would achieve further progress on the claim lodged; and if he will make a statement on the matter. The Central Fisheries Board has informed my Department of the Labour Court recommendation No. LCR17006. The recommendation deals with the claim by SIPTU on behalf of field grades employed by the fisheries boards for a reduction from 20 miles to five miles in the qualifying limit for the day subsistence allowance.

Under the Fisheries Acts the remuneration, allowances and terms and conditions of employment of fisheries board employees are determined by the boards with my approval given with the concurrence of the Minister for Finance. Accordingly, it is for the boards to decide how they wish to take this matter forward with the union in the light of the Labour Court recommendation. In this regard the CFB has not yet requested my approval or the approval of the Minister for Finance to reduce the qualifying limit from 20 miles. It is a matter for the CFB and the union to proceed with the negotiations envisaged in the Labour Court recommendation. They have not approached me in this regard.
