Written Answers. - Deportation Orders.

Question:

125 Mr. B. Hayes asked the Minister for Justice, Equality and Law Reform if he will permit persons (details supplied) in Dublin 24 to remain here and not to be deported back to Nigeria; and if he will make a statement on the matter. [1274/02]

The persons in question arrived in the State on 28 July 1999 and claimed asylum. Their claim was refused by the asylum division and they were notified of the decision on 6 April 2000. They appealed this decision on 10 April 2000. On 21 November 2001 the Office of the Refugee Appeals Tribunal notified them that the decision that they should not be declared refugees had been affirmed. In accordance with section 3 of the Immigration Act, 1999 the family in question were informed on 28 December 2001 that it was proposed to make deportation orders in their case. They were given the alternatives of either making representations within 15 working days setting out the reasons why they should be allowed to remain temporarily in the State, leaving the State before the orders are made or consenting to the making of deportation orders. Representations were received as to why they should be allowed remain in the State. I expect the case in relation to the persons in question to be submitted to me for decision shortly.
