14 Mr. Stagg asked the Minister for Justice, Equality and Law Reform when, in regard to his announcement of 12 February, it is expected that the full terms of reference will be announced for the tribunal of inquiry into allegations of improper conduct by members of the Garda in County Donegal; if there will be consultation with the Opposition parties regarding the final terms of reference; and if he will make a statement on the matter. 48 Mr. Howlin asked the Minister for Justice, Equality and Law Reform when, in regard to his announcement of 12 February, it is expected that the full terms of reference will be announced for the promised tribunal of inquiry into allegations of improper conduct by members of the Garda in County Donegal; if there will be consultation with the Opposition parties regarding the final terms of reference; and if he will make a statement on the matter. I propose to take Questions Nos. 14 and 48 together.

Draft terms of reference are currently being considered in my Department in consultation with the Office of the Attorney General. Of course I will consult with the main Opposition parties in relation to the terms of reference.

As Deputies will be aware, I intend to bring forward legislative proposals as a matter of urgency to ensure that the tribunal has the necessary powers of investigation and that it will function effectively without prejudicing related criminal proceedings. This legislation may have implications for the terms of reference. Therefore, it is my intention to have it in place before finalising the terms of reference.
