Question:

33 Mr. Rabbitte asked the Minister for Justice, Equality and Law Reform if new instructions have been issued to the Garda regarding the formal caution to be issued to persons suspected of drink driving; and if he will make a statement on the matter. [6083/02]

I am informed by the Garda authorities that subsequent to the case in question, referred to by the Deputy, no new formal instructions have been issued by the Garda Commissioner in respect of the formal request for the provision of breath, blood or urine specimens in the investigation of drink driving offences as the issue of such instructions is not deemed necessary. Gardaí will continue to be regularly reminded of their responsibilities in relation to the correct procedures to be followed in processing a drink driving case.

Questions in relation to any reform of the Road Traffic Acts, 1961, as amended, including the laws on drink driving, are matters for my colleague, Deputy Dempsey, Minister for the Environment and Local Government. The Deputy will be aware that the Road Traffic Bill, 2001, is currently before the Dáil.
