358 Mr. G. Mitchell asked the Minister for Justice, Equality and Law Reform if he will consider the appeal of persons (details supplied) in Dublin 12 to remain here. [6450/02]

The husband and two children of the family in question entered the State in December 1999 and his wife arrived in September 2000 and claimed asylum. Their claim was refused by the Refugee Applications Commissioner and they were informed of this decision on 29 August 2001. Their subsequent appeal was refused by the Refugee Appeals Tribunal on 11 January 2002.

In accordance with section 3 of the Immigration Act, 1999, the family in question were informed on 13 February 2002 that it was proposed to make deportation orders in their case. They were given the alternatives of either making representations within 15 working days setting out reasons they should be allowed to remain temporarily in the State, leaving the State before the orders are made or consenting to the making of deportation orders. Their reply is still awaited at present and I expect the case file to be submitted to me for consideration shortly.
