Question:

250 Mr. Quinn asked the Minister for Arts, Heritage Gaeltacht and the Islands the directives issued under the treaties establishing the European Communities any provision of which comes under the auspices of her Department which have not yet been transposed into law; if such transposition will be effected by Bill or statutory instrument; if transposition is overdue; if so, the steps taken by the European Commission by way of enforcement in each case; and if she will make a statement on the matter. The only such directive awaiting transposition by my Department is Directive 2001/38/EC of the European Parliament and of the Council of 5 June 2001 amending Council Directive 93/7/EEC on the return of cultural objects unlawfully removed from the territory of a member state. Consideration is ongoing as to the transposition of this directive which was due for transposition by the 31 December 2001. It is intended that the directive will be transposed by means of statutory instrument. No enforcement proceedings have been initiated by the European Commission to date.
