Vol. 549 No. 4

Written Answers. - Statutory Instruments.

Ruairí Quinn

Question:

252 Mr. Quinn asked the Minister for Arts, Heritage Gaeltacht and the Islands the proposed statutory instruments being prepared in, or under the auspices of, her Department; the proposed effect of each; and if she will make a statement on the matter. [7190/02]

The information regarding proposed statutory instruments requested by the Deputy is set out below. A consultation process under the Broadcasting (Major Events Television Coverage) Act, 1999, which will lead to the preparation of a statutory order, is ongoing. This is designed to ensure that events of major importance to society can be seen on free-to-air television. When the outstanding section 36, dealing with the regulation of commercial shoot operators, under the Wildlife (Amendment) Act, 2000, has been commenced, the associated statutory instrument will be formulated and implemented. The format of the statutory instrument to be effected under this section is the subject of consultation with the relevant interested parties in accordance with commitments given to this House. A reappraisal of the statutory instruments in the wildlife area is under way following commencement of the Wildlife (Amendment) Act, 2000. It is premature at this stage to say what new statutory instruments-regulations will be required as a consequence of that appraisal. Preparation of a statutory instrument to extend the existing network of special protection areas required under the EU Birds Directive, 79/409/EEC, is under consideration. A statutory instrument to implement Council Directive 2001/38/EC will be prepared shortly. This directive will enhance the provisions of the original directive which deals with the return of cultural objects unlawfully removed from the territory of a member state.
