Question:

106 Mr. Quinn asked the Minister for Foreign Affairs the Acts or sections or other provisions of Acts under the auspices of his Department or for the commencement of which his Department is responsible which have not commenced by reason of the fact that a commencement order has not been made; if it is intended to make such an order; if so, when; the reason for the failure to make such an order to date; and if he will make a statement on the matter. Section 4(3) of the European Communities and Swiss Confederation Act, 2001 provides that it will come into operation on such day as I may appoint by order. The purpose of this Act is to give effect to seven sectoral agreements between the European Communities and Switzerland. Of the seven agreements, one – the Agreement on the Free Movement of Persons – is an agreement involving mixed community and member state competence and accordingly it has to be ratified by all of the member states of the European Union, as well as on behalf of the European Communities and Switzerland, before it can enter into force.

All of the member states have by now ratified the Agreement on the Free Movement of Persons and pending completion of final arrangements by the Council secretariat, the agreement is expected to enter into force on 1 May 2002. I will make the necessary Commencement Order to bring the European Communities and Swiss Confederation Act, 2001, into operation from the same date.
