Question:

189 Mr. Kenny asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) in County Mayo is entitled to a suckler premium payment; and if he will make a statement on the matter. [8060/02]

The person named applied for premium for 20 animals under the 2001 suckler cow premium scheme. Following an examination of his application it was found that six animals were sold inside the six months retention period and were not replaced as required under the terms and conditions of the scheme. A formal notification dated 10 December 2001 issued to the applicant informing him that no suckler cow payment could be made for 2001 as clause 26 of the terms and conditions of the scheme had been contravened. The person named was informed that he could appeal this decision by contacting my Department within 21 days. There has been no further correspondence regarding this matter.
