Question:

201 Mr. Durkan asked the Minister for Agriculture, Food and Rural Development if he will review the recall of a REP scheme grant to persons (details supplied) in County Kildare, in view of the serious hardship likely to be caused and the fact that all requirements have been met; and if he will make a statement on the matter. [8238/02]

Following a compliance inspection, a penalty was imposed for failure to provide planned waste storage facilities, which is a fundamental and serious breach of the undertakings that the persons concerned had entered into under REPS. They appealed the penalty locally but were unsuccessful, and they were then informed of their right to appeal to the national REPS appeals committee. The appeals committee has received no appeal from them so far. The persons named may still exercise their right of appeal to the REPS appeals committee. The committee is independent and its decisions are final.
