Question:

64 Mr. McGrath asked the Tánaiste and Minister for Enterprise, Trade and Employment the position regarding regulations to eliminate kerbside petrol filling stations; and if she will make a statement on the matter. [7974/02]

At present, the operation of all petrol retail outlets is covered by the Dangerous Substances (Retail and Private Petroleum Stores) Regulations, 1979, as amended in 1988, 1999 and 2001.

Last December I made the Dangerous Substances (Retail and Private Petroleum Stores) (Amendment) Regulations, 2001. This legislation provides for the continued licensing until the end of this year of a number of petrol stations which had been in use before 1979.

Proposals to update the existing legislation have been developed by the Health and Safety Authority in consultation with the retail petrol industry. The proposed primary legislation will address the licensing of kerbside petrol stations on an individual risk assessment basis taking into account site management controls, quantities dispensed and location. It is my intention to bring forward during the year the necessary primary legislation to update the existing licensing regime.
