Section 180 of the Planning and Development Act, 2000, provides that either the developer or a majority of the residential estate's house owners or occupiers who are registered to vote in local elections can request the authority to take the estate's roads and other services in charge, by beginning the necessary procedures under section 11 of the Roads Act, 1993.
If a residential estate is finished by a developer in accordance with planning permission to the local authority's satisfaction, this request may be made at any time. If an estate has not been finished to the satisfaction of the planning authority but the authority has not brought enforcement action against the developer in the period of seven years following the expiry of the planning permission, the request may then be made by a majority of the estate's home owners or occupiers.
