Written Answers. - Deportation Orders.

Question:

436 Mrs. Owen asked the Minister for Justice, Equality and Law Reform the position regarding a person (details supplied) in County Mayo who is awaiting deportation. [10245/02]

The person referred to arrived in the State on 6 February 2000 and sought asylum. Following an interview, it was concluded that his application was not such as to entitle him to a declaration as a refugee. He was informed of this decision on 23 October 2000. His subsequent appeal was refused by the appeals authority on 9 November 2000.

In accordance with section 3 of the Immigration Act, 1999, the person in question was informed on 16 November 2000 that it was proposed to make a deportation order in his case. He was given the alternatives of either making representations within 15 working days setting out why he should be allowed to remain temporarily in the State, leaving the State before the order was made or consenting to the making of a deportation order. Many representations were received on his behalf, including from his legal representative. All representations were given consideration. A deportation order was signed on 19 February 2002. The person referred to was requested to present himself to the Garda in charge in Claremorris to enable his deportation. He was subsequently deported to Nigeria on 13 March 2002.
