57 Mr. Penrose asked the Minister for the Marine and Natural Resources the position regarding the infringements proceedings initiated by the EU Commission against Ireland in regard to a super-trawler (details supplied); and if he will make a statement on the matter. [9905/02]

The position is that the European Commission has recently adopted its decision crediting the Irish pelagic segment with additional fleet capacity and effort to take account of additional fishing opportunities in Mauritanian waters. This step, in conjunction with arrangements to address the power over-capacity in the pelagic segment, has enabled the vessel concerned to be fully licensed and registered as part of the Irish and EU fishing fleet. I expect, therefore, that the infringement proceedings, which appear now to be redundant, will not be pursued by the European Commission.
