Question:

44 Mr. N. Ahern asked the Tánaiste and Minister for Enterprise, Trade and Employment the measures taken to protect consumers who cancelled holiday trips to the Middle East and Asian destinations following the events of 11 September 2002 in the USA; if refunds can be arranged for such persons who were offered no protection or refunds when they cancelled their trips; and if she will make a statement on the matter. Cancellation of contracts is a civil and a legal matter outside the remit of my Department. The issue of taking measures of the type referred to by the Deputy was never raised with my Department.

However, I understand that the Office of the Director of Consumer Affairs provided advice to consumers, concerning cancellation of package holidays and flights following the events of 11 September 2001. Package holidays generally are covered by the Package Holidays and Travel Trade Act, 1995. This legislation is the responsibility of my colleague the Minister for Public Enterprise.
