318 Mr. Perry asked the Minister for Health and Children if, in the context of any current arrangements concluded with the medical defence organisations, the State has conferred indemnity on, or provided guarantees to, such organisations in respect of the transfer of liabilities for past, current and future obstetric claims; the cost, or potential cost of such arrangements to the State; and if he will make a statement on the matter. The Department of Health and Children entered into an agreement with the Medical Protection Society in 2001 which helped Irish consultant obstetrician-gynaecologists provide themselves with professional indemnity cover at an affordable cost. The terms of the arrangement are covered by a confidentiality clause in the agreement. I have asked officials of my Department to open discussions with the Medical Protection Society on the terms on which the confidentiality clause might be waived. I will communicate the outcome to the Deputy.
