495 Mr. Ring asked the Minister for Social, Community and Family Affairs the reason a person (details supplied) in County Mayo has not been approved for the carer's allowance. [12022/02]

The person concerned received reduced rate carer's allowance until 24 July 2001. Following a review of her entitlement, she was disallowed carer's allowance as her weekly means derived from her spouse's earnings exceeded the statutory limit. She appealed the decision and an appeals officer upheld the original decision. The decision of an appeals officer is final and conclusive and can only be reviewed in the light of new facts or fresh evidence. In this year's budget, provision was made for further improvements in the carer's allowance means test. The income disregard for single carer's allowance increased to €191 and the disregard for couples increased to €382 from April 2002. Arising from these improvements, her case is being reviewed and she has been requested to submit details of her husband's earnings. Her case will be re-examined on receipt of this information and she will be notified of the outcome. Under social welfare legislation, decisions in relation to claims must be made by deciding officers and appeals officers. The officers are statutorily appointed and I have no role in making such decisions.
