Question:

556 Mr. Higgins (Mayo) asked the Minister for Justice, Equality and Law Reform the reason for the delay in registration of a site for a new house by persons (details supplied) in County Mayo. [11437/02]

I am informed by the Registrar of Titles that an application for transfer of part was lodged on 28 January and that it is associated with dealing number D2001SM001867P, which is an application under section 49 (acquisition of title by virtue of long possession) of the Registration of Title Act, 1964. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, take some time to process. I am informed that the application in question cannot be completed until the section 49 application has been completed. I am also informed that notices of the application under Dealing Number D2001SM001867P were served on interested parties on 10 April 2002. I assure the Deputy that if no objections are received in relation to these notices, dealing number D2002SM000752H will receive further attention.

557 Mr. McGuinness asked the Minister for Justice, Equality and Law Reform the reason for the delay in registering a plot of land at Rathnure, County Kilkenny for a person (details supplied) in County Kilkenny; and if the application can be expedited. [11479/02]

I am informed by the Registrar of Titles that there is no record of the application as quoted by the Deputy having being lodged in the Land Registry. If the Deputy can come back to me with a date of lodgement and a Land Registry dealing number, I will make further inquiries on his behalf.
