Question:

561 Mr. P. Carey asked the Minister for Justice, Equality and Law Reform when the appeal by a person (details supplied) in Dublin 11 will be determined; and if he will make a statement on the matter. [11578/02]

The person in question entered the State on 16 December 1998 and claimed asylum. In a letter dated 18 September 2000 he was informed that his application for asylum had been refused. He appealed this decision, but the appeal affirmed the original decision. On 13 August 2001, a letter issued informing him that it was proposed to make a deportation order in respect of him and giving him 15 working days to make written representations setting out any reasons why he should be allowed to remain temporarily in the State. He was given the option of leaving the State before a decision whether or not to order his deportation was taken or of consenting to the making of a deportation order. Representations were received as to why he should be allowed to remain in the State and these are being considered by my Department. I expect the case file in relation to the person in question to be submitted to me for decision shortly.
