117 Mr. Rabbitte asked the Minister for Arts, Heritage Gaeltacht and the Islands if Dúchas has awarded a licence to Luas in respect of the laying of tracks across the archaeological site at Kingswood; and if she will make a statement on the matter. [12151/02]

The Railway Procurement Agency, which has responsibility for the Luas works, does not require a licence from Dúchas, the heritage service of my Department, in respect of the laying of tracks across the archaeological site at Kingswood. I understand that the agency has agreed, however, to carry out appropriate archaeological mitigation at the site. In this respect, Dúchas has issued archaeological excavation licences to permit the mitigation to be carried out and Dúchas has agreed to the laying of the tracks. The agency is liaising with Dúchas on an ongoing basis in relation to Luas works carried out in this area.
